Early reports suggest at least 77 people were transported to the hospital after an Amtrak train derailed on an I5 bridge between Tacoma and Olympia, Washington and possibly six more were killed in the crash.

The train was on its first day of high-speed service on a new route that was developed to bypass congestion and bring trains further inland instead of along the winding track that travels near Puget Sound. Amtrak train 501 left the rails around 7:30 a.m., causing at least one train car to fall onto the highway below striking vehicles on the morning commute while other cars dangled precariously off the side of the overpass.

Within hours of the derailment, the National Traffic Safety Board launched a go-team investigation into the crash and the Federal Railroad Administration was en route to the scene to determine the cause. The NTSB safety inspection will analyze potential causal factors such as-

  • Whether the crewmember had situational awareness and proper management of multiple tasks
  • Use of positive train control or other control system to enforce speed restrictions and prevent collisions
  • Whether enhanced safety measures are required to ensure the safety of passengers and bystanders
  • Whether track defects or obstructions played a role

PULASKI LAW FIRM PLLC

Located in Houston, Texas, we represent plaintiffs from across the United States, individually, and in class and mass actions.

Typically, we represent clients who have suffered serious injury, death or other damages from dangerous and defective products, medical malpractice, automobile accidents, premises liability, consumer fraud and deceptive business practices and toxic and environmental exposure to dangerous substances. Pulaski Law Firm PLLC takes great pride in our personal approach to the practice of law. By utilizing cutting-edge technology to keep our clients updated with recent case developments, we are able to build and maintain strong relationships with all of our clients. We treat our clients not just as business relationships, but as friends.

Over the last twenty years, Pulaski Law Firm PLLC has brought thousands of cases to resolution. Our goal is to treat each client as if he or she were our first and to work diligently to pursue his or her cause of action with all available means granted to us by the courts.

While it is too soon to know the cause of the crash, media reports that speed may have been a factor or that an obstruction may have been on the track. According to CNN, Positive train control -- which uses GPS, wireless radio and computers to monitor trains and stop them from colliding, derailing or speeding -- was not activated at the time of the crash, a rail line spokesman said. The train reportedly was traveling 80 mph in a 30-mph zone.

Lack of safety measures could also have played a role in the crash. In fact, Fox News reports that Don Anderson, the Mayor of Lakewood, said that it was only a matter of time before a deadly derailment would happen. He is advocating for enhanced safety measures and said the high-speed rail project “was never needed and endangers our citizens.” If you were injured in the Amtrak derailment or if your loved one died in the crash, contact us now. We will help you seek justice.”

  • Whether enhanced safety measures are required to ensure the safety of passengers and bystanders
  • Whether track defects or obstructions played a role

The NTSB will also investigate how the victims of the crash were removed from the train cars as well as the coordination efforts and efficacy of the transportation of the injured after the mass casualty incident.

Dozens of rail specialists with the NTSB will be on the go-team, including experts in

  • Mechanics
  • Signal systems
  • Train operations
  • Tracks
  • Human performance
  • Survival factors

One of the first factors investigators will analyze is how fast the train was going leading up to the derailment, and they will also analyze if there was crash-avoidance technology on the train or on the tracks and whether it was working properly. We will follow up with all NTSB and Federal Railroad Administration investigations into the causes of this catastrophic accident as part of the investigations we are currently conducting on behalf of the victims.

As safe as riding a train usually is, the fact of the matter is that human factors and track defects are the two most common causes of train accidents. When you are injured because the actions or behaviors of someone else, you have rights under the law, and we are fierce advocates for those rights.

Millions of people travel by train every year safely. But when an accident is caused by a negligent engineer, defective tracks, or poor track maintenance, you shouldn’t have to pay the price. In fact, federal law says that when someone is harmed by the negligence of others, the negligent party is liable for any injuries and losses caused by that negligence. When this happens, victims can hold the parties responsible for accident related injuries and the loss of a loved one.

DISCHARGING STUDENT DEBT OBLIGATIONS

When a school loses accreditation or closes because it cannot meet federal requirements, students are often left paying student loan obligations for worthless degrees or for credits that they might not be able to transfer to a similar program at another college.

Under a certain type of loan forgiveness called Borrower Defense Repayment or just Borrower Defense, students whose school mislead them or engaged in misconduct or violated certain state laws may have their loans forgiven, and be released from any further payment obligations. Students who are in default and parents who took out a PLUS loan to help pay for their child’s education may also be eligible to have their school loans discharged.

YOU MIGHT BE ELIGIBLE FOR BORROWER DEFENSE EVEN IF YOUR SCHOOL DID NOT CLOSE

To be eligible, you must be able to prove your school violated state law through act or omission directly related to your student loan or the educational service the loan was provided for. If you are eligible for forgiveness, you may have your outstanding loan debt forgiven, and you may be reimbursed for the amounts you have paid on the loans already.

Students who took out private loans or received funds through programs such as the Federal Family Education Loan Program, or a Perkins loan are not eligible to have these debts forgiven through the Borrower Defense program. Instead, they must take legal action against the school and use their recovery to pay their debt

Your Legal Rights

Filing Injury and Wrongful Deaths Claims with Amtrak

If you were injured in the Amtrak derailment, you will need to file an injury claim, just as you would if you were in a motor vehicle accident. If you've lost a loved one in the accident, you will need to file a wrongful death claim with Amtrak. When you do this, a claims adjuster for the railroad will contact you and work as a liaison between you and the company. They will review your injuries and losses, analyze typical awards for the type of injury you sustained, and report this estimate to both you and the railroad and determine the amount of benefit that you should be paid.

But railroad companies aren’t in the business of paying passenger claims and they may do just about anything to limit their liability. Passenger injury claims and wrongful death claims are expensive, and you can bet that any railroad company will have a team of attorneys on their side, protecting their interest.

You need a team of experienced railroad accident attorneys on your side, protecting the interests of you and your family.

Massive Train Derailment Leads to Injuries and Deaths

Speed, Obstruction on Track, Lack of Safety Enhancements May be the Cause

A federal judge has preliminarily approved a settlement on behalf of all college athletes. This settlement includes terms for return-to-play guidelines, education, training, and medical monitoring. What this settlement does not provide is financial compensation for former athletes who continue to struggle with the side effects of traumatic brain injuries. It is our belief that the NCAA should provide compensation for their injured players just like the NFL agreed to compensate their players for the host of neurological diseases that can be caused by concussion.

The NCAA has been mistreating and failing players for many years. In 2010, an NCAA survey revealed that almost one-half of the respondents admitted they placed players back into the same game after the players had suffered a concussion. A survey by the Chronicle of Higher Education in 2013 revealed that almost one-half of responding trainers reported feeling pressure from coaches to return players who suffered concussions to the field before the players were medically fit to return to the game. Despite knowing for decades that concussion injuries can lead to long-term dangers, the NCAA disregarded these dangers and put players at risk.

Passenger Injury Claims

Unfortunately, Congress passed a law that limited or capped the amount of compensation passenger rail accident victims can receive from the railroad company to $200 million. Since that law took effect, there have been several Amtrak mass casualty accidents, including:

2015 – Pennsylvania – Amtrak regional train derails, killing eight and injuring more than 200 people. Experts believe that there will not be enough money to compensate all victims because of the legal cap.

2011 – Nevada – Amtrak passenger train hit by a large truck kills six and injures 16 more. Amtrak and Union Pacific railroad were awarded more than $4.5 million in their lawsuit, while lawsuits filed on behalf of the victims are still pending.

2002 – Florida – Amtrak passenger train derails on a curve, killing four and injuring 142, due to inadequate track repair. Class action lawsuits and individual lawsuits were filed on behalf of victims, but settlement amounts in those cases are not clear.

But prior to the law, awards were higher. For example, in 1997 a jury awarded the widow of a man killed in a train derailment $50 million after it determined track inspectors failed to make repairs to a track switching mechanism.

Because of these limits, it is critical that passenger train accident victims investigate all potentially responsible entities who could have played a role in an accident and are not protected by the same limitations.
